Terms of Service

1. Acceptance of Terms

By accessing or using FOKIQ at fokiq.com ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Blue Snow Developers LLC ("we," "us," "our").

2. Description of Service

FOKIQ is a free daily brain puzzle game that tests cognitive abilities across six domains: Pattern Recognition, Memory, Spatial Reasoning, Speed Processing, Logical Deduction, and Language Skills. The Service includes daily challenges, leaderboards, multiplayer modes, and related content.

3. Eligibility

The Service is available to users of all ages. Users under 13 should use the Service under parental supervision. No account creation is required to play.

4. User Conduct

By using FOKIQ, you agree not to:

  • Use automated scripts, bots, or tools to manipulate scores or leaderboards
  • Submit false, misleading, or fraudulent information
  • Attempt to interfere with the Service's operation, security, or infrastructure
  • Exploit bugs or vulnerabilities rather than reporting them to us
  • Impersonate other users on leaderboards or in multiplayer modes
  • Use the Service for any unlawful purpose

We reserve the right to remove scores, ban users, or restrict access for violations of these terms.

5. Intellectual Property

All content on FOKIQ — including puzzles, game mechanics, visual design, code, MindMap visualizations, blog content, and the FOKIQ brand — is owned by Blue Snow Developers LLC and protected by intellectual property laws.

You may:

  • Share your scores, MindMap, and brain type via the built-in sharing features
  • Link to fokiq.com from your website or social media
  • Discuss FOKIQ in reviews, articles, and content

You may not:

  • Copy, reproduce, or redistribute our puzzles, algorithms, or content
  • Use the FOKIQ name, logo, or branding to imply endorsement
  • Scrape, crawl, or extract data from the Service beyond normal usage
  • Create derivative works based on our puzzle designs or game mechanics

6. User-Generated Content

If you set a nickname, participate in duels, or create challenges, you grant us a non-exclusive, worldwide, royalty-free license to display that content within the Service (e.g., on leaderboards, in duel results). You retain ownership of any content you provide.

7. Leaderboards & Scores

Leaderboard scores are public. By submitting a score to the leaderboard, you consent to its public display alongside your nickname (if set) and approximate location (city-level, if available). We reserve the right to remove scores that appear to be the result of cheating, exploits, or manipulation.

8. Free Service

FOKIQ is currently free to use. We reserve the right to introduce optional paid features in the future, but existing free functionality will remain accessible. We will never retroactively charge for features that were previously free.

9. Availability & Changes

We strive to keep FOKIQ available 24/7, but we do not guarantee uninterrupted access. We may:

  • Modify, update, or discontinue features at any time
  • Change puzzles, scoring formulas, or game mechanics
  • Perform maintenance that temporarily makes the Service unavailable

We will make reasonable efforts to communicate significant changes.

10. Disclaimer of Warranties

FOKIQ is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

  • The Service will be error-free or uninterrupted
  • Results or scores will be accurate in all circumstances
  • The Service will meet your specific requirements

FOKIQ is a game, not a medical or diagnostic tool. Brain training scores and cognitive profiles are for entertainment and self-improvement purposes only. They are not clinical assessments and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

11. Limitation of Liability

To the maximum extent permitted by law, Blue Snow Developers LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed $50 USD.

12. Indemnification

You agree to indemnify and hold harmless Blue Snow Developers LLC from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or misuse of the Service.

13. Privacy

Your use of FOKIQ is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which Blue Snow Developers LLC is registered.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
